The Seller undertakes to respond to written or electronic correspondence from the Buyer without undue delay, no later than within two (2) business days.
2. INTRODUCTORY PROVISIONS
2.1
These Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) of FoxMarket, spol. s r.o., with registered office at Bělohorská 274/9, 169 00 Prague 6 – Břevnov, Company ID: 04033523, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, File No. 241471 (hereinafter referred to as the “Seller”), govern, pursuant to Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), the mutual rights and obligations of the contracting parties arising in connection with or based on a purchase contract (hereinafter referred to as the “Purchase Contract”) concluded between the Seller and another natural person (hereinafter referred to as the “Buyer”) via the Seller’s online store.
The online store is operated by the Seller on the website located at www.nanukcase.cz (hereinafter referred to as the “Website”) through the website interface (hereinafter referred to as the “Online Store Interface”).
The Buyer may be a consumer or a business entity.
A consumer is any individual who, outside the scope of their business activity or independent professional activity, enters into a contract with the Seller or otherwise deals with the Seller. Consumer relationships are governed by Act No. 40/1964 Coll., the Civil Code, as amended, and related regulations.
A business entity is a person who independently performs gainful activity on their own account and responsibility on a trade or similar basis with the intention of doing so systematically for profit. For the purposes of consumer protection, a business entity also includes any person entering into contracts related to their own business, manufacturing or similar activity, or acting independently in the performance of their profession, or a person acting on behalf of or for the account of a business entity. Business relationships are governed by Act No. 513/1991 Coll., the Commercial Code, as amended, and related regulations.
2.2
By submitting an order, the Buyer confirms that they have familiarized themselves with these General Terms and Conditions (hereinafter referred to as “GTC”), which include the method of concluding the contract, the complaints procedure, and the method of delivery, and expressly agrees to them in the wording valid and effective at the time of submitting the order.
2.3
The Buyer acknowledges that by purchasing products offered at www.nanukcase.cz, no rights arise to use registered trademarks, trade names, company logos, etc., unless otherwise agreed in a specific contract.
2.4
The Buyer will receive an order confirmation at the email address provided. A tax document containing the basic details of the contract will be sent to the Buyer by email before the goods are handed over to the carrier or upon personal collection at the Seller’s premises.
2.5

2.6
Deviating provisions from these Terms and Conditions may be agreed upon in the Purchase Contract. Such deviating provisions take precedence over these Terms and Conditions.
2.7
These Terms and Conditions form an integral part of the Purchase Contract. The Purchase Contract and the Terms and Conditions are drawn up in the Czech language. The Purchase Contract may be concluded in Czech, Slovak, or English.
2.8
The Seller may amend or supplement the wording of these Terms and Conditions. This shall not affect rights and obligations arising during the validity of a previous version of the Terms and Conditions.
3. USER ACCOUNT
3.1
Based on registration on the Website, the Buyer may access their user account. From the user account, the Buyer may order goods (hereinafter referred to as the “User Account”). If the Online Store Interface allows it, the Buyer may also order goods without registration directly via the Online Store Interface.
3.2
When registering on the Website and ordering goods, the Buyer is obliged to provide correct and truthful information. The Buyer must update the information in their User Account whenever it changes. The information provided by the Buyer is considered correct by the Seller.
3.3
Access to the User Account is secured by a username and password. The Buyer is obliged to maintain confidentiality regarding the information necessary to access their User Account.
3.4
The Buyer is not entitled to allow third parties to use the User Account.
3.5
The Seller may cancel the User Account, especially if the Buyer does not use it for a long time or if the Buyer breaches their obligations under the Purchase Contract (including these Terms and Conditions).
3.6
The Buyer acknowledges that the User Account may not be available continuously, especially due to necessary maintenance of the Seller’s hardware and software or that of third parties.
4. CONCLUSION OF THE PURCHASE CONTRACT
4.1
All presentation of goods placed in the Online Store Interface at www.nanukcase.cz is for informational purposes only, and the Seller is not obliged to conclude a Purchase Contract regarding such goods. Section 1732(2) of the Civil Code does not apply.
4.2
The Online Store Interface contains information about goods, including prices. Prices are stated inclusive of VAT and all related fees. Prices remain valid while displayed in the Online Store Interface.
4.3
The Online Store Interface also contains information on costs associated with packaging and delivery. These costs apply only to deliveries within the Czech Republic.
4.4
To order goods, the Buyer completes the order form in the Online Store Interface. The order form contains in particular:
4.4.1
Information about the ordered goods (the Buyer places the goods into the electronic shopping cart),
4.4.2
Information about the payment method, delivery method, and delivery costs (hereinafter collectively referred to as the “Order”).
4.5
Before submitting the order, the Buyer is allowed to review and change the data entered. The order is submitted by clicking the “submit order” button. The Seller considers the information provided correct and confirms receipt of the order by email.
4.6
Depending on the nature of the order, the Seller may request additional confirmation (e.g. in writing or by phone).
4.7
The contractual relationship arises upon delivery of the order acceptance (order confirmation) sent by the Seller to the Buyer by email.
4.7.1
If the ordered goods are not in stock, the contractual relationship arises after both parties agree on availability and price. The Buyer must respond within seven (7) calendar days.
4.8
The Buyer agrees to the use of distance communication means. Costs incurred by the Buyer are borne by the Buyer and do not differ from the basic rate.
5. PRICE AND PAYMENT TERMS
5.1
Information about goods and prices is binding except in the case of obvious error or sold-out stock.
5.2
The Buyer may pay the purchase price by:

cash at the Seller’s premises,

cash on delivery,
-
bank transfer to account No. 2500820805/2010 (FIO BANKA a.s.).
5.3
The Seller does not charge fees based on the payment method.
5.4
The Buyer is also obliged to pay delivery and packaging costs.
5.5
Cash and COD payments are due upon receipt of goods. Bank transfers are due within seven (7) days of concluding the contract.
5.6
In case of bank transfer, payment is completed when credited to the Seller’s account.
5.7
The Seller may require full payment before dispatch.
5.8
Discounts cannot be combined.
5.9
The Seller issues a tax document (invoice) after payment and sends it electronically.
6. WITHDRAWAL FROM THE PURCHASE CONTRACT
6.1
The Buyer acknowledges that withdrawal is not possible for customized goods.
6.2
Unless otherwise stated, the Buyer may withdraw within fourteen (14) days of receipt of goods.
6.3
In the event of withdrawal, the Buyer must return the goods within fourteen (14) days and bears return costs.
6.4
The Seller will refund payments within fourteen (14) days using the same payment method.
6.5
For business entities, the Seller may charge handling and transport costs.
6.6
If returned goods are damaged, the Seller may deduct compensation.
6.7
The Seller may withdraw from the contract before delivery.
6.8
For personal returns, refunds will be made within seven (7) days.
7. PERSONAL COLLECTION OF GOODS
7.1
Personal collection is possible at selected premises.
7.2
If in stock, goods may be collected immediately.
7.3
If stored elsewhere, collection is possible the next business day.
7.4
If not collected within seven (7) business days, the order will be cancelled.
8. DELIVERY OF GOODS
8.1
Delivery is carried out by a shipping or transport company.
8.2
Special delivery requests are at the Buyer’s risk.
8.3
Goods are dispatched within two (2) business days unless stated otherwise.
8.4
The Buyer must accept delivery between 8:00 and 18:00.
8.5
Repeated delivery costs are borne by the Buyer.
8.6
The Buyer must inspect packaging upon delivery.
8.7
Additional delivery terms may apply.
8.8
The Seller is not responsible for carrier delays.
9. DELIVERY PRICE
9.1
Delivery prices within the Czech Republic depend on carrier pricing and shipment weight and are published at http://www.nanukbags.com.
10. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE
11. WARRANTY PERIOD
11.1
The warranty period begins upon receipt.
11.2
The statutory warranty period is twenty-four (24) months.
11.3
For business entities, warranty conditions follow the Commercial Code and manufacturer terms.
11.4
Transport damage claims are handled by the carrier.
12. COMPLAINTS

14. PERSONAL DATA PROTECTION

15. DELIVERY OF COMMUNICATION
15.1
Communication may be delivered electronically or by post.
16. FINAL PROVISIONS
16.1
Czech law applies.
16.2
Disputes are resolved by Czech courts.
16.3
Supervision is carried out by the Czech Trade Inspection Authority.
16.4
Invalid provisions do not affect the remaining terms.
16.5
The Purchase Contract is archived electronically and is not publicly accessible.
These Terms and Conditions are effective from 1 January 2026.
